Whether it is mandatory to register my Establishment under the HP Shops & Commercial Establishments Act, 1969.

Answer

Any establishment which is falling within the area notified under the Act ibid, registration is mandatory for each and every shops/establishment. List of areas/bazaar is available on website of the department.

How one can get himself registered under the Act?

Answer

Duly filled application for registration is submitted to the Inspector, HP Shops & Commercial Establishments of the Circle concerned and the same is now available On-Line by accessing http://labour.hp.gov.in/

What are the necessary enclosures to be enclosed with the application form to obtain the Registration Certificate under the Act?

Answer

Identity Proof, Rent deed/affidavit in support of ownership, address and location of Shop/Establishment has to be submitted.

How can one know the registration & renewal fee under the Act?

Answer

Payment of the fee is specified in the Schedule which is also at the website of the Department and can be accessed http://labour.hp.gov.in/

Is there any cutoff date for the submission of renewal application?

Answer

Yes, every registration is required to submit one month prior the date of renewal.

What is the penalty for submitting renewal application after cutoff date?

Answer

If the application for renewal is not received within the time, the license shall be renewed only on payment of late fee @ 25% in excess of the fee ordinarily payable for the license.

Registration Certificate shall be granted for a period of one year and five years.

For any amendment of Registration Certificate, Rs. 50/- per amendment will be charged.

Answer

Yes, certain documents in support of amendments which are to be made are required to be submitted alongwith Form No.4 in duplicate.

One will get registration certificate faster, if the documents are complete in all respect in one go.

Whether displaying of the Registration Certificate is mandatory for all establishments?

Answer

Registration Certificate (Form No.3 alongwith Form No. 7) must be displayed at conspicuous place in the premises of the shop/establishment.

Which type of Statutory Record pertaining to workers is mandatory to maintain?

Answer

Records of attendance, wages, over time, damages & loss, register of advance (on prescribed formats) etc are mandatory to be maintained by the employer and must be preserved for at least three year.
