The permission to a NON AGRICULTURIST applicant to get the land transferred in his/ her name shall be for any or more of the following purposes in the following scale

For construction of Houses and Flats

An area not exceeding  1500 square metres

For setting up of Hydel Project

Area as recommended and approved by the MPP& Power Department of H.P.

Forms to be filled:

          The application should be submitted in Form LR-XIV
          Form LR-XIV (Part-I) Permission for Purchase
          Form LR-XIV (Part-II) Supporting Documents

Supporting Documents:

          Part-II of Form LR-XIV  Documents to be attached for obtaining permission for purchase of Land in Himachal Pradesh by non-agriculturists.

Fee:

There is no fee for obtaining permission for the purchase of land.

Procedure:

Eligible person may apply in Form LR-XIV duly supported with documents specified, to the Collector in whose Jurisdiction the land is situated.  

On receipt of the application, complete in all respects, the collector  shall,  after  calling  the  information  from the revenue staff (Tehsildar/ Naib Tehsildar concerned) in  Form-XV and holding such inquiry as he may deem fit, verify the title of  the  land in question and if he is of the opinion that the application  should   be   accepted,   he   shall   recommend application  within  a period of 30 days from the date of its receipt by him to the state government (F.C.Revenue) for  its consideration.

On receipt of the recommendation made by the collector, the State Government shall consider the application and allow or reject the application.

The applicant shall be informed of every order passed by the State Government.

What if the Government rejects the Application?

Any applicant whose application has been rejected, may, within 60 days of the date of order of rejection, apply to the state government to review the order and the Government may, after making such further inquiry as it may think fit, pass such orders as it considers necessary; provided that State Govt.  may  entertain the review application after the  expiry of the said period of 60 days, if it is satisfied that the applicant was prevented by sufficient cause  from  filing the review application in time.

Time Limit:

The information regarding grant of permission to purchase land or its rejection is communicated to the applicant within 3-months time under normal circumstances.
